DB Pensions

BANGS V. BANGS (59 Md. App. 350, 1984) In a deferred distribution (QDRO), the marital portion is the benefit at retirement, multiplied by the coverture fraction as at that point in time. The numerator is marital service, and the denominator is total service at retirement.

QUINN V. QUINN (No. 1561, Court of Special Appeals of Maryland, 1990) In valuing a pension, post-separation efforts are non-marital.

WOODSON V. SALDANA (165 Md. App. 480, 885 A.2d 907, 2005) The trial court erred in using a time-based fraction to determine the marital share of military reserve pension, in which a point system is used to translate reserve duty into creditable pension time. The marital share of such a pension is marital points divided by total points.
